ORCHARD PARK, N.Y. (WIVB) – The Buffalo Bills have settled a class-action lawsuit after accusations they sent too many text message alerts to fans who were part of their text messaging service. In October 2012, Florida resident Jerry Wojcik sued the team, saying he received unauthorized text alerts.

Wojcik said the service was for up to five texts per week and he received 13 messages over two weeks. The Buffalo Bills are paying up to $3 million, mostly in the form of debit cards to the Bills store at Ralph Wilson Stadium or on the team’s website.

The Bills will pay more than $560,000 to Wojcik’s lawyers and $5,000 to Wojcik for acting as class representative in the suit.

The Bills released this statement Tuesday, “The Buffalo Bills have reached a settlement in this matter which we believe is in the best interest of our organization and our fans. The purpose of the Bills voluntary, opt-in text messaging program was to provide our fans with information they requested about the team. The organization maintains that our text messaging program was in compliance with the law.”

Attorney James S. Giardina released this comment about the suit, “(The) plaintiff is pleased the court granted preliminary approval of the class settlement, which was only reached after substantial negotiations with the court-appointed mediator.”
