In a major legal victory for Texas businesses and a loss for workers, a federal appeals court ruled Tuesday that companies can require employees to sign contracts prohibiting them from taking class action against the company.
The 5th U.S. Circuit Court of Appeals decided that the National Labor Relations Board had violated federal law when it disallowed Fort Worth-based D.R. Horton from requiring such agreements in employee contracts.
However, the three-judge panel found that employment agreements such as Horton’s cannot bar workers from filing labor grievances with the federal government.
